A.G. Paxton urges lawmakers to "test" Supreme Court precedent on border security

AUSTIN, Texas — Republican Attorney General Ken Paxton told lawmakers in a Senate committee hearing on Thursday he wants to see legislation that would "test" a 2012 Supreme Court decision on the state's authority in border security.
Paxton was invited to speak before a Senate committee on border security, where he offered suggestions on how Texas legislators can address a recent influx in migrants coming in illegally at the state's border with Mexico. One of his primary suggestions involved approving legislation that would, ultimately, be challenged by the federal government to potentially affirm the state's authority on border security.
As it stands, the federal government holds the ultimate authority in managing the nation's borders. A 2012 decision from the U.S. Supreme Court, Arizona v. United States, effectively solidified the federal government's authority over that of states in managing border security.
